These Terms of Service (hereinafter "ToS" or "Terms of Service") apply to the services offered on the website https://holidog.com. The services offered on this site are published by the company Holidog, a simplified joint-stock company (SAS) under French law with a capital of 46,537.20 euros, registered in the Paris Trade and Companies Register under number 492 909 007 and having its registered office at 10 Rue de Penthièvre, 75008 Paris (hereinafter "Holidog"). The site hosting is provided by Amazon Web Services, Inc., a US company with its registered office at PO BOX 84023, Seattle, WA 98124-8423, USA.
In these Terms:
The use of the Site and the Service is subject to acceptance of these ToS, which are systematically accessible on the Site. These ToS determine the rights and obligations of Holidog and the Members (together the "Parties" or individually a "Party") for the various contracts offered on the Site. When creating a User Account, Members must tick the box: "I accept the Terms of Service and Privacy Policy of Holidog and confirm that I am at least 18 years old." Only acceptance of the ToS allows Members to access the services offered by the Site. Acceptance of these ToS is complete and forms an indivisible whole, and Members cannot choose to have only part of the ToS applied or make reservations. By accepting the ToS, the Member agrees in particular to Article III.3 of the ToS concerning the processing of Members' personal data. By the mere fact of validating their registration, creating a User Account, their order and/or Booking a Service on the Site, the Member declares having read, understood and accepted without reservation the terms of said registration, creation, order or Booking, as well as all of these ToS. In the event of a breach of any of the obligations provided for herein, Holidog reserves the right to delete the User Account concerned.
Holidog reserves the right to modify at any time: – these ToS, – the features offered on the Site, – or the operating rules of the Service. The modification will take effect immediately upon the posting of the new ToS that any user acknowledges having previously consulted. Rejection of the new Terms of Service must be explicit. Without explicit expression of intent before the new provisions come into force, the Member will be deemed to have accepted the modifications.
To register and benefit from the Service offered by Holidog, each Member must first create a User Account by providing personal data about themselves, essential for the proper functioning of the Service (including name, surname, age, title, valid telephone number and email address, characteristics of the Animal's care where applicable, etc.). Members certify that they are over 18 years old at the time of registration and are fully capable of contracting. The Member is responsible for the information provided to Holidog in their User Account and undertakes to verify that this information is accurate at all times. In case of error, the Member undertakes to immediately correct this information or to inform a Holidog operator. Holidog cannot in any way be held responsible for erroneous or fraudulent information communicated by Members. The Member undertakes not to create or use accounts other than the one initially created, whether under their own identity or that of third parties. Any exception to this rule must be the subject of: – an explicit request from the Member, and – express and specific authorisation from Holidog. The creation or use of new accounts without authorisation may result in the immediate suspension of the Member's accounts and all associated services.
Holidog provides a Matchmaking Service between Clients and Petsitters. This Service includes: – the provision of a search engine and filters allowing the Client to find a Petsitter meeting their criteria; – the provision of an internal messaging system allowing the Parties to exchange before the Booking; – the management of the Booking and online payment (via an approved third-party payment service provider); – the temporary holding of funds until the end of the Service; – the possible application of the HoliVet guarantee on eligible Bookings. The Services that may be offered by Petsitters via the Site include: – boarding or "pet sitting" at the Petsitter's home, – home care or "house-sitting" at the Client's home, – walking from the Client's home, – visits to the Client's home. Services are provided exclusively by Petsitters, in their name and under their responsibility. Holidog is never a party to the care contract concluded between the Client and the Petsitter.
The Matchmaking Service operates as follows: – The Client registers on Holidog and fills in their Pet's profile (characteristics, particular behaviours, specific needs). – The Client searches for Petsitters via the Site. – The Client contacts one or more Petsitters via internal messaging to verify: • their availability, • their suitability for their expectations, • the conditions of the planned Service. – The Petsitter confirms via the platform that they accept the Service under the agreed conditions. – The Client validates their Booking on the Site and proceeds with online payment (Petsitter's rate + Service fees + HoliVet fees, if applicable). – Holidog collects the funds and holds them via the payment provider until the end of the Service. – The Petsitter performs the Service on the agreed dates, times and conditions. – At the end of the Service, and unless a dispute is declared within the prescribed deadlines, Holidog pays the Petsitter their share within 48 hours, minus applicable fees. In case of dispute (particularly manifest poor performance of the Service), Holidog may suspend or cancel payment to the Petsitter, proceed with a full or partial refund to the Client and apply the measures in Article II.7.
Each Booking corresponds to a specific Service (dates, type of service, location, Petsitter's rate, number of Animals, etc.) and is subject to a single payment by the Client at the time of validation. The applicable pricing conditions are indicated to the Client before validation of the Booking.
The prices displayed on the Site include: – the price of the Service freely set by the Petsitter (excluding commissions); – Service fees (platform fees) charged by Holidog; – HoliVet fees, automatically applied with each booking. The prices in effect are those displayed on the Site on the day of the Booking. They may be modified for the future, with already paid Bookings not being affected. The Client makes a single payment to Holidog covering all amounts due. Holidog: – collects the funds, – holds them via its payment provider until the end of the Service, – pays the Petsitter their share, except in case of dispute or application of provisions related to poor Service or HoliVet. II.4.1 – Petsitter Commission Holidog applies a commission of up to fifteen percent (15%) on the price of the Service set by the Petsitter. This commission is deducted from the amount paid out to the Petsitter after completion of the Service. The exact amount received by the Petsitter after deduction of the commission is displayed prior to confirmation of the Booking. II.4.2 – Pet Sitter payout requirements (payment details) Payout of amounts due to the Pet Sitter at the end of the Service is conditional upon the Pet Sitter providing and completing the information required to receive funds (including bank details/IBAN and any information required by the payment service provider). If such information is missing, inaccurate, incomplete, or not validated, Holidog may hold the funds through its payment service provider until the Pet Sitter completes the required steps. The Pet Sitter acknowledges that failing to provide or validate the required payment information may delay or prevent payout. Holidog may remind the Pet Sitter through various channels (notifications, emails, user space) to complete the required information. The Pet Sitter must complete and validate the required payment information within a maximum period of six (6) months from the end date of the Service in order to claim payout. If this deadline is exceeded, and subject to applicable legal and operational constraints, Holidog may treat the funds as unclaimed in accordance with these ToS and applicable law. In such case, the Pet Sitter acknowledges that they may no longer be entitled to receive payout. In all cases, payout to the Pet Sitter can only occur once the required payment information is fully completed and validated. A payment and Booking confirmation email is sent to the Client upon validation.
The Client undertakes to use the Platform fairly and transparently and to provide all information necessary for the proper performance of the Service. Declaration of Animal Characteristics When making a Booking, the Client undertakes to declare all relevant characteristics of the Animal, including: • particular behaviours (runaway, destructive, aggressive, fearful, barking, climbing animal, etc.), • known pathology or ongoing treatment, • specific needs in terms of maintenance, hygiene, safety, food or care, • any information that may impact the safety of the Petsitter or the proper performance of the Service. This information is essential to allow the Petsitter to accept the assignment with full knowledge of the facts. Failure to comply with this essential obligation may result in: • the Petsitter's refusal to provide the Service, even after Booking, • no refund of Service fees and HoliVet fees (except in cases provided for in these ToS), • the obligation for the Client to immediately collect the Animal, • the possibility for the Petsitter, in case of proven impossibility to keep the Animal safely, to temporarily place it in boarding or with an association, at the exclusive expense of the Client. The choice of the most appropriate measure is at the reasonable discretion of the Petsitter, depending on the severity of the undisclosed behaviour. Prior Communication Before any validation and payment, the Client undertakes to: • communicate exclusively via Holidog messaging, • never transmit their personal contact details, • verify the availability and agreement of the Petsitter, • provide all useful information to allow the Petsitter to evaluate the request. Holidog cannot be held responsible if the Client proceeds with payment without having verified the availability or agreement of the Petsitter. Liability for Damage Caused by the Animal The Client remains solely responsible for all damage caused by their Animal to third parties, the Petsitter, other animals or property. It is the Client's responsibility to: • verify that they have civil liability insurance covering domestic animals, • report any incident or bite if local regulations require it, • compensate victims of damage caused by their Animal, in accordance with the law. Certain situations may be covered by the HoliVet commercial guarantee. Verification of Information Provided by Petsitters Profile content is provided directly by Petsitters. Holidog: • manually validates profiles, • may intervene in message moderation, • may suspend a profile in case of obvious inconsistency. However, Holidog does not guarantee the accuracy of information provided by Petsitters. The Client must verify, via messaging, that the Petsitter meets their expectations. Holidog cannot be held responsible for: • the choice made by the Client, • a withdrawal by the Petsitter, • or incompatibility found between the Client and the Petsitter.
The Petsitter undertakes to use the Platform honestly, provide accurate information and provide Services with seriousness, diligence and respect for animal welfare. Information Provided During Registration Upon registration, the Petsitter undertakes to provide accurate and up-to-date information regarding: • their identity (surname, first name), • their profile and skills, • their care environment (accommodation, presence of children or animals, reception conditions), • their actual availability, • the types of Services they accept, as well as associated rates. The Petsitter undertakes to update their information as soon as an element becomes incorrect, incomplete or obsolete. Holidog manually validates profiles but does not guarantee the accuracy of information provided by the Petsitter. Legal Compliance and Personal Obligations of the Petsitter The Petsitter remains solely responsible for compliance with legal and regulatory obligations that may apply to their activity, including: • rules relating to animal care, • tax obligations (income declaration), • safety obligations when receiving animals at their home or at the Client's home. The Petsitter also undertakes to have civil liability insurance covering damage caused during the Service. Communication and Availability The Petsitter undertakes to: • communicate exclusively via Holidog messaging, • answer the Client's questions honestly via Holidog messaging, • confirm their actual availability, • report any unexpected change that may affect the Service, • respect agreed schedules, • immediately notify the Client in case of delay, unforeseen circumstances or problems. Performance of the Service The Petsitter undertakes to: • ensure the safety, well-being and health of the Animal throughout the Service, • follow the instructions given by the Client (food, medication, schedules, habits), • perform the Service according to best practices, in accordance with what was agreed, • monitor the Animal in a manner appropriate to its needs, • immediately contact the Client in case of incident, accident or concerning behaviour. In case of veterinary emergency, the Petsitter undertakes to act in the interest of the Animal and follow the procedure indicated by Holidog and the Client. Prohibitions and Prohibited Behaviours The Petsitter undertakes to: • never transmit their personal contact details, • never entrust the Animal to an unauthorised third party, • never leave the Animal unsupervised when its safety could be endangered, • never practise violence, abuse or neglect, • not create or use multiple accounts without authorisation from Holidog. Any serious infringement may result in immediate suspension of the Account, withholding of payment and exclusion of the Petsitter. Petsitter Liability The Petsitter is solely responsible for: • damage they may cause to the Client or third parties, • damage caused to the Animal resulting from negligence, breach of their obligations or poor performance of the Service, • compliance with local laws concerning animal care. Holidog may intervene to: • suspend the Account in case of inappropriate behaviour, • support the settlement of a dispute, • cancel a Booking and refund the Client in case of serious breach by the Petsitter. The Petsitter acknowledges that there is no subordination or partnership relationship between them and Holidog. They carry out their activity independently and on their own account.
Holidog operates a platform allowing Clients and Petsitters to connect, exchange, make a Booking and use associated services (payment, messaging, evaluation tools). Holidog is never a party to the care contract concluded between a Client and a Petsitter. Holidog does not exercise any supervision, control or direct management over the Services. Petsitters act independently, in their own name and under their sole responsibility. Nature of Holidog's Role Holidog provides: (i) a search and matchmaking tool, (ii) internal messaging, (iii) a booking and payment system managed via a third-party payment provider, (iv) tools facilitating communication, evaluation and, where applicable, the application of the HoliVet guarantee. Holidog is not a boarding centre, does not employ Petsitters, does not train Petsitters, and does not provide any boarding, walking or visiting Service. Limits of Liability Holidog's liability cannot be engaged in case of damage resulting from: – erroneous, incomplete or misleading information provided by a Member, – the incompetence or behaviour of a Petsitter, – a cancellation made by a Client or Petsitter, – non-compliance by a Petsitter with their legal or contractual obligations, – fraudulent behaviour by a Member, – an incident, damage, injury, illness or death of an Animal during the Service, – fraudulent or illegitimate use of a payment method by a Member, – temporary inability to access the Site, – use of the Site not in accordance with these ToS. Holidog does not guarantee the quality, safety, compliance or suitability of the Petsitter's Services. Holidog is in no way responsible for damage, losses, thefts, deterioration or damage occurring at the home of the Petsitter or Client, nor for personal effects, objects, furniture, property or animals present on the premises. The security of the home, property and animals is the exclusive responsibility of the Petsitter and the Client, depending on the Service concerned. In particular, Holidog assumes no responsibility in case of: • theft or disappearance of personal effects at the home of the Petsitter or Client; • damage to property, furniture, objects or equipment in the home; • deterioration of premises, outdoor spaces or installations; • intrusions, break-ins, loss of keys, or any security incident occurring during or in connection with the Service. In case of disagreement or dispute relating to material damage, settlement occurs exclusively between the Petsitter and the Client, Holidog not being a party to the care contract and not being bound by any obligation of repair, compensation or guarantee in this regard. Content, Profiles and Communications Information published on profiles is provided by Petsitters under their exclusive responsibility. Holidog performs manual checks but cannot guarantee the accuracy or completeness of the content transmitted. Holidog may moderate exchanges via internal messaging, including by blocking or deleting messages contrary to the law or ToS. Third-Party Services and Integrated Tools The Site may integrate services provided by third parties, such as: – approved third-party payment provider (Stripe), – mapping services (Google Maps), – identity verification services, – technical hosting tools (AWS). Use of these services implies acceptance of the terms of use of these third parties. Holidog cannot be held responsible for errors, unavailability or damage caused by these providers. Sharing Information in Case of Emergency Holidog may share certain personal information of a Member with another Member or a veterinarian in cases strictly necessary for: – protecting the Animal, – preventing serious and imminent danger, – managing a health emergency, – assistance in finding a lost Animal, – managing a security-related dispute. This sharing is limited to strictly necessary information and complies with applicable laws. Suspension and Termination Holidog may suspend or delete an Account, without notice, in case of: – violation of the ToS, – fraud, attempted fraud or deception, – danger to an Animal, Member or third party, – abusive, aggressive or discriminatory behaviour, – obviously false or misleading information, – misuse of the platform, – repeated disputes related to the quality of Services. Financial Liability Limitation Any liability that may be incurred against Holidog is expressly limited to the total amount of Service fees paid by the Member during the last twelve (12) months.
The Matchmaking Service and Booking management are provided upon confirmation of the Booking and payment on the Site. The Client acknowledges that by validating a Booking and making a payment, they are requesting immediate performance of the Matchmaking Service and associated services (matchmaking, messaging, Booking management, payment processing). In accordance with EU Directive 2011/83 on consumer rights, as transposed into applicable national law, the right of withdrawal does not apply: – to service contracts fully performed before the end of the withdrawal period when performance has begun with the prior express consent of the consumer and their acknowledgement of the loss of their right of withdrawal, – nor, where applicable, to services related to leisure activities providing for a specific date or period of performance. By validating payment, the Client consents to immediate performance of the Matchmaking Service and acknowledges that they waive their right of withdrawal for these services upon their performance. This waiver does not deprive the Client of: – mandatory rights recognised by applicable consumer legislation, – nor refund rights provided for by the cancellation policy and provisions relating to poor Services and disputes.
This policy governs the cancellation conditions for Bookings made via the Platform. Walking (24-hour deadline) Any cancellation made at least twenty-four (24) hours before the scheduled time of the walk entitles to a full refund (excluding Service fees and HoliVet fees). Any cancellation made within twenty-four (24) hours before the walk entitles to a refund of fifty percent (50%) of the corresponding service (excluding Service fees and HoliVet fees). Deadlines are assessed according to the Petsitter's timezone. Boarding, House-Sitting and Visits (72-hour deadline) Any cancellation made at least seventy-two (72) hours before the start of the Service entitles to a full refund (excluding Service fees and HoliVet fees). Beyond this deadline, the Client is entitled to a refund equal to fifty percent (50%) of unconsumed days (excluding Service fees and HoliVet fees). Shortening a Booking Reducing a confirmed Booking is fully refunded when it occurs before the expiration of the applicable seventy-two (72) hour deadline (excluding Service fees and HoliVet fees). Beyond this, only fifty percent (50%) of removed days or nights are refunded (excluding Service fees and HoliVet fees). Cancellation by the Petsitter Any cancellation initiated by the Petsitter results in a full refund including: — Service fees, — HoliVet fees, — applicable VAT, for the unconsumed portion. Holidog may offer available alternatives. Refund Terms and Scope Refunds are made to the original payment method and generally appear within five (5) to ten (10) business days. Service fees and HoliVet fees are never refunded when a cancellation originates from the Client. In case of cancellation by the Petsitter or recognised force majeure, all fees are eligible for refund. Any cancellation must be made via the Platform to take effect.
Poor Services In case of manifest poor performance of the Service (non-performance, serious negligence, lack of supervision, non-compliance with essential instructions), the Client must: – immediately notify the Petsitter, – inform Holidog without delay via available contact channels, – provide all useful supporting evidence (exchanges, photos, veterinary invoices, etc.). Possible Measures by Holidog As part of its intermediary role, Holidog may, after analysing the situation and without being obligated to: – withhold or suspend payment due to the Petsitter, – cancel the payment and proceed with a full or partial refund to the Client, – offer an additional commercial solution, – suspend, sanction or exclude the Account of the Petsitter concerned. These measures are discretionary and do not constitute an obligation for Holidog. Booking Cancellations The applicable cancellation policies are those displayed on the Site and/or in the booking flow. – In case of cancellation by the Petsitter before or during the Service, Holidog may refund the Client for the unrealised part and help them find another available Petsitter. – In case of cancellation by the Client, refunds are made in accordance with the cancellation policy applicable to the Booking. The date retained for cancellation is that of the request made via the tools provided on the Site, regardless of any separate exchange between Members. Disputes Between Clients and Petsitters Disputes between Members are primarily resolved through dialogue between the Client and the Petsitter, via Holidog messaging. Holidog may, without being obligated, intervene in mediation, analyse the elements provided and propose a solution. Holidog reserves the right, in case of manifest abuse, to: – block or limit certain accounts, – suspend or permanently delete a User Account, – subsequently refuse to contract with an excluded Member or one who has committed serious breaches.
Failure to Collect the Animal If the Client does not collect their Animal at the scheduled end date and time of the Service, the situation may be equated to abandonment and put the Animal in danger or difficulty. Possible Measures The Petsitter and Holidog may, depending on circumstances: – attempt to reach the Client and their emergency contacts, – contact a veterinarian, shelter, animal protection association or competent authorities, – temporarily organise an alternative care solution. All costs (boarding, transport, care, etc.) remain entirely the responsibility of the Client. Immediate Danger In case of immediate danger to the Animal (serious illness, accident, suspected abuse, dangerous environment), the Petsitter acts in the interest of the Animal and informs Holidog as soon as possible.
Client Contact Details and Instructions Where possible, the Client provides: – contact details for a regular veterinarian, – instructions to follow in case of emergency, – any known contraindications (allergies, ongoing treatments, etc.). Authorisation for Emergency Intervention If the Client cannot be reached within a time frame compatible with the emergency, the Petsitter is authorised to: – consult the veterinarian indicated by the Client, or – failing that, consult any reasonably accessible veterinarian. The Client authorises the Petsitter, Holidog and the veterinarian consulted to exchange, if necessary, information relating to the Animal to enable its care. Coverage of Veterinary Costs Veterinary costs incurred in this context are, in principle, the exclusive responsibility of the Client, without prejudice to the possible application of the HoliVet guarantee when the conditions are met.
Holidog strives to ensure the availability of the Site and Service 24 hours a day, 7 days a week. However, access to the Site or Service may be interrupted due to maintenance operations, hardware or software upgrades, emergency site repairs, or circumstances beyond Holidog's control (such as failure of telecommunications links and equipment). Holidog undertakes to take all reasonable measures to limit these disruptions, insofar as they are attributable to it. Members acknowledge and accept that Holidog assumes no responsibility towards them for any unavailability, suspension or interruption of the Site or Service and cannot be held responsible for direct and indirect damages of any nature resulting from this. In all cases, and without prejudice to what has been set out above and in other clauses concerning Holidog's lack of responsibility, any cause of liability that could be attributed to Holidog may only result in the payment of damages limited to the amounts collected as Service fees.
Breaches and Faulty Behaviour In case of: – non-compliance with these ToS, – payment incident, – provision of erroneous or fraudulent information, – acts likely to harm the interests of Holidog, other Members or the security of the Site, Holidog reserves the right to: – limit or suspend, at any time and without prior notification, the Member's access to the Site or Service, – permanently delete the Member's User Account, – refuse access to the Site to a Member who has already been excluded or sanctioned. No damages may be claimed by the Member in this regard.
